Terms of Service
Last updated: 13 October 2026
These terms are the agreement between you and Appetite Technology (Pty) Ltd (registration number 2023/849612/07), trading as Appetite Host ("we", "us"), of 350 Parkstation Road, Greenwood Park, Durban, 4051, South Africa, when you use appetitehost.co.za or buy a website package from us. That address is also where legal documents may be served on us. We have written these terms in plain language on purpose. If anything is unclear, email support@appetitehost.co.za before you buy.
Two sections limit what we are responsible for, or ask you to cover our costs in certain cases. They are in highlighted boxes so you cannot miss them: section 12 and section 16. Please read them before you pay.
1. Who can use Appetite Host
You must be at least 18 and buying for a real business or venture you are entitled to represent. If you buy on behalf of a company, you confirm you have the authority to bind it. You agree to give true, current information. Your website says what you tell us, and your web address is registered using the details you provide.
2. What you are buying
A package (Founder, Professional Plus or Professional Turbo) made up of three things:
- a website built with you by Naya, our design assistant;
- your own .co.za web address, registered in your name; and
- your first year of the monthly service, paid upfront in the package price: keeping your website online, secure and backed up, and making changes within your plan's limits.
What each plan includes, such as the most pages your website can have and how many Naya credits you get each month (a change to your website uses 1, a new page 5), is set out on our pricing page and at checkout. After your first year, the monthly service carries on month to month at your plan's monthly price until you cancel (section 8).
3. What we promise
- Your website is live within 1 working day of payment. Your web address is registered as soon as you confirm your email, and usually starts working the same day.
- Your web address is registered in your name. You own it, not us.
- We keep your site online, secure and backed up as part of the monthly service.
- You can change your site yourself, or by asking Naya, within your plan's limits.
- We do the work with reasonable care and skill, as the Consumer Protection Act requires.
4. What we ask of you
- Give true information about your business.
- Only publish content you have the right to use, and nothing unlawful, misleading, defamatory or harmful. We may take down content that breaks this rule, and where the breach is serious we may suspend the service after asking you to put it right. Anything that puts people at immediate risk, such as a page stealing passwords, we take offline straight away (see our abuse page).
- Keep your sign-in email secure. Anyone with access to it can change your site.
- Do not try to interfere with, overload, or gain unauthorised access to our service or other customers' sites.
5. Your content stays yours
Everything you give us (your business information, text, photos and logo, and what you tell Naya) remains yours, and so does the wording Naya writes for your website. You give us permission (a non-exclusive, royalty-free licence) to store, display, back up and adapt it only as needed to build and run your website. If you leave, that permission ends and you can take a copy of your content with you.
Photos from our library. Where we use pictures from our own photo library on your website, you may keep using them, free of charge, on your website and your business's own marketing, including after you leave us. You may not sell them or offer them as a collection to anyone else.
6. Naya, sample reviews and Google reviews
Naya writes your website from what you tell her, using AI. AI-written text can occasionally be inaccurate or not quite right for your business. You see everything before it goes live, and you are responsible for checking that your site's claims about your business (prices, services, qualifications) are true. If something is wrong, change it yourself or ask Naya and she will fix it.
Sample reviews. If you have no reviews yet, Naya may offer to show sample reviews in your preview, so you can see how that part of your website will look. She only does this if you say yes, and each one is marked as a sample. Samples never appear on your live website.
Google reviews. If you ask us to, your website can show your business's public reviews from Google. They are shown exactly as Google provides them, with Google's name on them, and Google's own terms apply to them. We cannot edit or remove a Google review; only Google can.
7. Our platform stays ours
The Appetite Host platform, Naya, our designs and our software remain our property. Your package gives you full use of your website; it does not transfer our software or allow you to copy or resell our platform. Websites we build show a small "Powered by Appetite Technology" credit at the bottom of the page.
8. Payments, renewals and price changes
The package price is a once-off amount, shown in rand at checkout and paid when you buy. Appetite Technology is not registered for VAT, so no VAT is added: the price shown is the full price. You can pay by card or instant EFT. Payments are handled by Paystack, our payment provider. Card details go straight to Paystack; we never see or store your card number.
Before your first year ends we email you, between 40 and 80 working days before the end date, to remind you that the monthly service is about to start, what it costs, and how to cancel if you do not want it. You do not need to do anything to keep your website.
From year two we charge your plan's monthly price once a month, using the payment details saved with Paystack, until you cancel. If a payment does not go through, we try again over the following week and email you each time. If it still has not gone through about two and a half weeks after the first attempt, your website is paused (not deleted), and it comes back the moment payment succeeds. We keep your website and content for at least 30 days after it is paused.
Naya credits. Your plan includes a number of Naya credits each month. They renew on the 1st, and unused ones do not carry over. You can also buy extra credits on your account page, at the prices shown there. Extra credits never expire and are used only once your monthly credits are used up. They are charged to the payment details you saved, or paid on Paystack's payment page. Credits are used when Naya prepares a change or answers a question, whether or not you go ahead with it, and Naya tells you before anything that uses more than one. Credits have no cash value. Extra credits are covered by our 30-day refund (section 10); when a purchase of credits is refunded, the credits from it that you have not used are removed. Unused extra credits end when your account ends.
Price changes. We may change the monthly price. If we do, we email you at least one month before the new price applies to you. If you do not want to pay it, you can cancel before then with no penalty.
9. Messages from your website visitors
Your website has a form that lets visitors send you a message or ask for a quote. When they do, we act on your behalf, as your "operator" under the Protection of Personal Information Act, and you are the business responsible for that information. We agree to:
- use those messages only to deliver them to you, and for nothing else;
- keep them confidential and protected with the same safeguards we use for our own data;
- keep them for 12 months, so you have a record, and then delete them; and
- tell you immediately if we discover they may have been accessed by someone without permission.
You agree to use what your visitors send you lawfully, and only to reply to them and do business with them.
10. Refunds and cancelling
Thirty days, no conditions. If you are not happy, tell us within 30 days of a payment and we will refund that payment in full. No reason is needed, nothing you do to your website forfeits it, and there is no deduction for the web address we registered for you, which stays yours either way. The details are on our Refund Policy page.
Cancelling later in your first year. After those 30 days, you can still cancel at any time. Your website stays up until the end of your first year, and the package price is not refunded, because the website has been built and delivered. If you are buying as an individual rather than a company, the Consumer Protection Act also lets you end the first year early on 20 working days' notice. In that case we credit you for the remaining whole months of the first year at your plan's monthly price, less a reasonable cancellation charge of no more than one month's price, and pay that credit back to you.
Cancelling from year two. Cancel any time by emailing support@appetitehost.co.za. You will not be charged again, and your website stays up until the end of the month you have paid for.
11. Your web address
Registration, renewal and any move of your web address are covered by the Web Address Agreement, which is part of these terms.
12. Fair limits
We work hard to keep everything running, but no online service can promise zero interruptions, and we cannot control failures at the providers the internet runs on. If something breaks, we fix it as fast as we can.
We are not liable for events beyond our reasonable control, such as load-shedding and power failures, undersea cable breaks, outages at the payment, registry or other providers we depend on, natural disaster, or unrest.
Apart from that, our total liability to you is limited to the amounts you paid us in the twelve months before the claim, and we are not responsible for indirect losses such as lost profits or lost business.
These limits do not apply to loss caused by our gross negligence, our deliberate wrongdoing or our dishonesty, or to anything else the law does not allow us to limit. Nothing in this section takes away rights the Consumer Protection Act gives you.
13. Changes to the service
We improve the platform continually, so features change: things get added, and occasionally something is replaced by a better version of itself. We will not remove a capability your plan promised you without telling you first and, where it matters, giving you a reasonable alternative. Your published website keeps working throughout.
14. New and experimental features
Sometimes we offer something early, clearly marked as new or in testing, so you can try it and tell us whether it helps. Those features may change or be withdrawn, and are not part of the promises in section 3. Using them is always your choice: nothing experimental is switched on for your live site without you asking.
15. Links and services beyond ours
Your website may link to other places, such as your WhatsApp, a booking tool, a map or your social pages. Those are run by other people under their own terms and privacy practices, and we are not responsible for them. The same goes for any third-party service you connect to your site.
16. If your site causes a claim
You are responsible for what your website says and sells. If someone brings a claim against us because of content you supplied or how you run your business (for example, a trademark complaint about a logo you gave us), you agree to cover our reasonable costs of dealing with it. This does not apply where the problem was caused by us, including by wording or photos we chose for you without your instruction.
17. Ending the agreement
You can cancel as set out in section 10. We can end the agreement if you seriously break these terms and do not put it right within 20 working days of our written notice; content that puts people at immediate risk is dealt with straight away under section 4. Either way, your web address remains yours, we will help you take it elsewhere, and you may ask for a copy of your content for 30 days after the service ends.
18. If something goes wrong between us
Talk to us first: email support@appetitehost.co.za and we will try in good faith to sort it out within 30 days. If we cannot, you may take the matter to the Consumer Goods and Services Ombud or the National Consumer Commission, and either of us may go to a South African court with jurisdiction, including the Small Claims Court. For anything about your personal information, you can also go to the Information Regulator (see our Privacy Policy).
19. The legal bits
- South African law applies to this agreement.
- If any part of these terms turns out to be invalid, the rest still stands.
- If we choose not to enforce a term on one occasion, we can still enforce it later.
- These terms, the Web Address Agreement, the Refund Policy and the Privacy Policy are the whole agreement between us and replace anything said earlier.
- If we change these terms, we email you about the change at least 20 working days before it applies to you. If you do not agree, you can cancel before then with no penalty, and we refund any part of a payment that covers time after you leave. Changes the law requires, or that only help you, can apply sooner.
